    • China to appeal WTO ruling over rare earth exports

China said Wednesday it would appeal against a World Trade Organisation (WTO) ruling that it illegally restricted exports of key raw materials. The WTO last month upheld complaints by the United States, European Union and Mexico, ruling that China had failed to abide by accession commitments when it imposed quotas and duties on several types of minerals. The complainants charged that export quotas and duties imposed by Beijing on the raw materials were illegal and against commitments China made when it joined the world trade body.

    • American Pols' Selective Support for the WTO

A little over two weeks ago, a WTO panel released its decision in a dispute between the US and China over the United States' imposition of antidumping and countervailing duties (CVDs) against imports from China.  The ruling covers a lot of interesting and important US-China trade issues, including whether the simultaneous imposition of antidumping and countervailing duties against Chinese imports results in "double remedies" on those imports and whether such double counting violates WTO rules.

    • China CVD, ctd: The Wasted Opportunity

Yesterday, I took the first of what will likely be many looks at the Appellate Body's new "US-China CVD" decision and concluded that, from a legal perspective, the decision would have pretty significant (and likely adverse) implications for the United States Government.  From a policy perspective, however, it appears that Friday's ruling has cost the US much, much more, and the Obama administration only has itself to blame.

As you may recall, when the United States passed a law in March 2012 overruling a couple federal court decisions and retroactively applying US law to scads of completed countervailing duty investigations of Chinese imports, I explained that the law's illogical, biased structure - in particular, not addressing WTO-inconsistent "double counting" in any case completed before the law's enactment - all but guaranteed at least one WTO cha

    • WTO: China Unfairly Limits Export of Raw Materials

(GENEVA) — The World Trade Organization ruled Monday that China unfairly limited exports of nine raw materials to protect domestic manufacturers. A WTO appeals body rejected China’s appeal of an earlier ruling in July that concluded the Asian economic powerhouse had violated international trade rules.

    • China and the WTO: A Marriage Doomed to Fail?

Last week the World Trade Organization, in particular China's membership in the global trade body, came under scrutiny from the anti-trade left and, surprisingly, the (mostly) pro-trade right.  The former's response was totally expected as the logical extension of anti-traders' longstanding "strategy" of seizing on some new headline as ex post justification for their opposition to trade liberalization.
